    • Josh is a Senior Associate in the firm’s Construction and Engineering Department. Josh qualified in September 2009 and joined Birketts in January 2013.

      Josh has experience in a range of contentious construction and commercial disputes and advises clients on all aspects of construction litigation; from following the pre-action protocol procedure through court proceedings concluding at trial and also through the statutory adjudication procedure.
      Josh has considerable experience of conducting litigation in the county court and high court/technology and construction court and is able to provide advice on all forms of alternative dispute resolution, including negotiation and mediation.  

      Josh works for local authorities, social housing providers, employers and the supply chain, advising on various types of construction disputes. Josh acts for a number of regional and national house builders with post-sale defects claims, helping them to find workable and commercial solutions. Josh has been instructed in relation to a number of professional negligence claims against other legal professionals and more commonly, construction professionals such as architects, contract administrators and surveyors. 

      Josh has very good working relationships with a number of nationally recognised expert witnesses who often assist with the resolution of disputes. He also regularly instructs specialist construction barristers to assist with the procedural elements of the court process. 

      Additionally, Josh is a member of the construction and engineering team’s recoveries and realisations team and often assists contractors and professionals recover unpaid invoices, retention and fees. Josh is experienced in the recovery process, whether through the Courts or adjudication and has successfully enforced a number of adjudicator’s decision and county court judgments. Josh is familiar with winding-up proceedings and regularly acts for both petitioning creditors and for clients who require swift injunctive proceedings in response to winding-up petitions issued against them as an abuse of process.
